TERMS OF USE

Effective Date: May 25, 2026

By downloading, installing, or using Blockers ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

Eligibility

You must be at least 13 years of age to use features that require Apple Game Center. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

License

WhimsyWare grants you a limited, non-exclusive, non-transferable, revocable license to use the App on any Apple-branded device that you own or control, for personal, non-commercial purposes, subject to these Terms and the Apple Licensed Application End User License Agreement.

Intellectual Property

All game content, including but not limited to graphics, sounds, music, themes, game mechanics, and text, is the property of WhimsyWare and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the App without our prior written consent.

User Conduct

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the App
• Use automated tools, bots, or scripts to interact with the App
• Exploit bugs, glitches, or vulnerabilities to gain unfair advantages on leaderboards
• Manipulate Game Center leaderboards or achievements through any means
• Attempt to interfere with the App's operation or servers

Game Center

The App integrates with Apple Game Center for leaderboard and achievement features. Your use of Game Center is subject to Apple's terms and conditions. We reserve the right to remove leaderboard entries that we reasonably believe were obtained through cheating or exploitation.

In-App Purchases & Virtual Items

The App may offer in-app purchases. All purchase transactions are processed by Apple and are subject to Apple's terms and refund policies. We do not process or store any payment information.

Virtual items obtained through in-app purchases or gameplay (including but not limited to cosmetic items, themes, or game modifiers) have no real-world monetary value, are non-transferable, and are licensed to you — not sold. We reserve the right to modify, rebalance, or remove virtual items at any time. Except as required by applicable law, in-app purchases are non-refundable.

Availability

We do not guarantee that the App will be available at all times or without interruption. We may modify, suspend, or discontinue the App or any part of it at any time without notice.

Termination

We may terminate or suspend your access to the App at any time, without prior notice, if you violate these Terms. Upon termination, your license to use the App is revoked. Any virtual items associated with your use may be forfeited upon termination.

Disclaimer of Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by applicable law, WhimsyWare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the App.

Maintenance and Support

WhimsyWare, not Apple, is responsible for providing any maintenance and support services for the App. Apple has no obligation to provide any maintenance or support services with respect to the App.

Product Claims

WhimsyWare, not Apple, is responsible for addressing any user or third-party claims relating to the App, including but not limited to product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.

Intellectual Property Claims

WhimsyWare, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim related to the App.

Third-Party Services

The App may use third-party services (such as Apple Game Center and Apple's StoreKit). You agree to comply with any applicable third-party terms when using these services.

Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will update the "Effective Date" at the top of this page when changes are made. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
